Property Exempt from Probate

Most assets that you own are subject to the probate process following your death. However, if the value of your property is worth $150,000 or less, and/or if you own certain types of property, those assets can be passed to your loved ones without having to initiate a formal probate process. 

Specifically, these are the types of property that can be passed without a probate:
  • Up to $150,000 worth of cash and/or other assets not listed below
  • Property held in a trust
  • Property held in joint tenancy with another person
  • Property in which the decedent had a life estate (rare)
  • Joint bank accounts
  • Vehicles
  • Most vessels (boats, etc)
  • Manufactured homes, mobile homes, commercial coaches, truck campers, floating homes
  • Any compensation due for services in the Armed Forces
  • Up to $15,000 in unpaid or uncollected salary or compensation, including cash value of unused vacation time
In a future blog post, I will describe the process for collecting the above assets without having to initiate a formal probate.
